Terms of Service

1. Agreement to Terms

By accessing or using fypnow ("the Service"), operated by fypnow, LLC, a Delaware limited liability company ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

fypnow is an AI-powered analytics platform that helps creators and businesses analyze TikTok video performance, identify content patterns, track competitors, and generate data-driven content strategies. The Service includes free tools, paid subscription plans, and AI-generated insights.

3. Account Registration

  • You must provide accurate, complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 16 years old to use the Service.
  • You may not create multiple accounts to obtain additional free trials or to circumvent plan limits.
  • You are responsible for all activity that occurs under your account.

4. Subscriptions and Billing

  • Paid plans are billed on a recurring monthly or annual basis through our payment processor.
  • Your subscription renews automatically unless you cancel before the end of the current billing period.
  • Prices may change with 30 days' notice. Existing subscriptions will honor the current price until the next renewal.
  • Except where required by law, subscription payments are non-refundable. See our Refund Policy for full details, including how the 7-day free trial (Creator and Starter plans) works.
  • Your video catalog is a standing limit — the total number of analyzed videos your plan can store — not a monthly allowance. AI scripts and viral-trend searches are monthly allowances that reset at the start of each billing cycle and do not roll over. Refreshing metrics on videos you already hold does not count toward your catalog limit.

5. Acceptable Use

You agree not to:

  • Use the Service to violate any applicable law or regulation.
  • Upload any video you do not own or otherwise have the rights to upload and have analyzed.
  • Upload video depicting any identifiable person who has not consented to appear in it, or any person under 16.
  • Upload unlawful, infringing, sexually explicit, or abusive material, or content you are contractually barred from sharing.
  • Scrape, crawl, or otherwise extract data from the Service for competing products.
  • Attempt to gain unauthorized access to other users' accounts or our systems.
  • Use the Service to harass, stalk, or harm other individuals.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Reverse-engineer, decompile, or disassemble any part of the Service.
  • Use AI-generated scripts or content from the Service to impersonate real individuals without their consent.
  • Resell access to the Service without our written permission.

6. TikTok Data and Third-Party Platforms

  • fypnow analyzes publicly available TikTok data. We are not affiliated with, endorsed by, or sponsored by TikTok or ByteDance.
  • We do not guarantee the accuracy, completeness, or availability of third-party platform data.
  • TikTok may change their platform, APIs, or policies at any time, which may affect the functionality of our Service.

7. API and MCP Access

Paid plans include access to our REST API and our MCP server, which lets you connect FYPNow to an AI assistant such as Claude. These are part of the Service and everything in these Terms applies to them, including Section 5 (Acceptable Use) and Section 6 (TikTok Data and Third-Party Platforms).

  • Credentials are yours to protect. An API key is shown once and stored only as a hash; we cannot recover it. You are responsible for activity carried out with your keys and connections, and must revoke any credential you believe has been exposed. You can do this at any time in Settings → API.
  • One workspace per credential. Every key and every connection acts on exactly one workspace. Attempting to reach another workspace's data through the API is a breach of these Terms.
  • Access follows your plan. API and MCP access require an active paid subscription and are checked on every request. If your plan lapses or is cancelled, existing keys and connections stop working, even though they were valid when created.
  • Quotas and rate limits apply. Requests count against the same plan allowances as the dashboard. We may apply rate limits to protect the Service and the third-party data sources it depends on, and may suspend access that degrades the Service for others.
  • Automated use is permitted; abuse is not. You may call the API from your own software and from AI assistants you control. You may not resell or redistribute bulk access, present the API as your own service, or use it to reconstruct a competing dataset.
  • Actions taken by an AI assistant are your actions. If you authorise an assistant with write access, operations it performs — analysing videos, generating scripts, creating niche watchers, searching trends — consume your plan quota and are attributed to you. Grant read-only access if you do not want an assistant to spend quota.
  • We may change the API. We will avoid breaking changes where practical and will publish material changes in advance, but the API is evolving and endpoints may be added, changed or deprecated.

Our handling of the data these connections create — what is stored, for how long, and how to revoke a connection — is described in Section 2.4 of our Privacy Policy.

8. AI-Generated Content

  • The Service uses AI to analyze videos and generate insights, scripts, and recommendations.
  • AI-generated content is provided for informational and creative purposes only. It is not guaranteed to be accurate, complete, or suitable for any specific purpose.
  • You are solely responsible for reviewing, editing, and verifying any AI-generated content before publishing or acting on it.
  • We do not claim ownership of AI-generated content created for you. You retain rights to use it as you see fit.

9. Intellectual Property

  • The Service, including its design, code, branding, and documentation, is owned by fypnow, LLC and protected by intellectual property laws.
  • You retain ownership of any content you upload or create using the Service. Uploading a video does not transfer any ownership of it to us.
  • By using the Service, you grant us a limited license to process your data as needed to provide the Service. For videos you upload, that means storing the file and processing its visual and audio content — including through our third-party AI provider — to generate a review for you.
  • We do not use videos you upload to train AI models, and we do not make them available to other customers or publish them.
  • You are responsible for ensuring you hold the rights to every video you upload, and you agree to indemnify us against claims arising from content you upload.

10. Limitation of Liability

To the maximum extent permitted by law, fypnow and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

12. Termination

  • You may cancel your account at any time through the billing settings or by contacting us.
  • We may suspend or terminate your account if you violate these Terms or engage in activity that harms the Service or other users.
  • Upon termination, your right to use the Service ceases immediately. We may delete your data after a reasonable retention period.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you via email or through the Service at least 14 days before the changes take effect. Your continued use of the Service after changes take effect constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Delaware.
